What are the most common places for slip and fall accidents?

While an individual can slip and fall at any time, the most common places for slip and fall accidents are parking lots, sidewalks and walkways outside of businesses, driveways, supermarkets, restaurants, shopping malls, schools, stairwells, escalators, and playgrounds.

What types of surfaces and obstructions should I avoid?

An individual can slip and fall almost anywhere, particularly if he or she is not paying attention to the surrounding environment and observant of the risks it may pose. The types of surfaces and obstructions which should be avoided if you want to lessen your chances of sustaining injury in a slip and fall accident are: uneven sidewalks, pavement defects, places where snow or ice has been allowed to accumulate, area where carpeting is worn or raised, places which are inadequately lit, potholes or other depressions in the ground, floors made wet or slippery after food and drink spills, as well as any place where electrical cords and wires have not been properly put away.

What steps should I take if I've been injured in a slip and fall accident?

The first thing you should do is report the accident to the store manager, business owner, landlord or the individual who is responsible for maintaining the building or property where you fell. Gathering witness statements can help prove your case and prevent those responsible from claiming that they cannot be held legally liable. Photos, notes, a sample of what caused your spill and any other documentation will be helpful too.

If you did not receive immediate medical attention, see a doctor as soon as you can. Do not accept any settlement agreement or sign any papers without first seeking counsel from a lawyer. Doing so could waive your right to fair and just compensation.

What is the potential worth of my claim?

Each claim will be different. It is the type of accident, as well as the injuries you sustained, which will have the most impact on your claim's potential worth. We always work hard to help our clients maximize their claims and we will stop at nothing to help you recover the compensation you are entitled to receive. Call us now so that we can review your case and begin assessing its potential value.

Will I need a lawyer to represent my case or can I just file a claim with the insurance company?

If you want to have any chance of maximizing your claim, you are going to need a lawyer fighting on your behalf. Do not expect an insurance company to have your best interests in mind. Many insurance companies will do whatever they can to avoid having to pay out on claims. Be wary of insurance companies who offer a quick settlement or immediate compensation in exchange for waiving one's rights to pursue further legal action.

Giving an insurance company a recorded statement of the accident, agreeing to a settlement or signing any papers they present without first obtaining the counsel of a skilled personal injury lawyer is not advised. Hiring a lawyer from our firm will give you an unwavering advocate when fighting to recover the compensation you deserve.

If I slipped and fell at another person's house, or on personal property, who's responsible for my injuries?

The individual or individuals responsible for your injuries will depend largely on the cause of your slip and fall accident. If you tripped and fell on the steps leading up to the homeowner's door, the homeowner can be held liable for your injuries as it is his or her responsibility to keep the property properly maintained.

In cases where an individual is only renting a home, you may be able to pursue compensation from the renter, the landlord or both depending on what caused you to slip and fall. A leaky faucet that caused water to accumulate on the floor could be traced back to either the homeowner or the individual currently renting the home. Our lawyers are more than capable of helping you determine who can be held responsible for your injuries and we stand ready to provide you with hard-hitting legal representation in your pursuit of compensation.
